Connolly Gallagher attorneys Max Walton, Lisa Hatfield, and Brandon Harper defeated a motion for a preliminary injunction filed by Plaintiff claiming that a City of Rehoboth Beach policy, banning unattended displays (including a crèche that Plaintiff desired to erect on or near the City’s Bandstand), violated various constitutional provisions. The Court held that the City’s policy is constitutionally valid, and declared that other aspects of the case are moot or otherwise unripe.
