DeLuca successfully defended New Castle County’s determination that deed restrictions in the Pike Creek Valley do not supersede the County’s zoning and land use authority for the area. The Court determined that the applicable restrictive covenant is in addition to, not preemptive of, the UDC density rules. The case is on appeal to the Delaware Supreme Court.
