Rehoboth Art League, Inc. v. Board of Adjustment of Town of Henlopen Acres, 991 A.2d 1163 (Del. 2010).

On appeal to the Delaware Supreme Court, Connolly Gallagher attorneys successfully defended the Board of Adjustment’s decision to deny a use variance. The Delaware Supreme Court held that: (1) the Board did not deny the Petitioners due process rights; (2) the Board was biased; and (3) that the Board’s decision was not supported by substantial evidence.
