On July 29, 2016, the Delaware Superior Court issued a 49-page opinion in favor of Connolly Gallagher client Leads School of Technology Practical Nursing Program (now known as Adoni Health Institute) that allows the School to keep its doors open. In an unusual ruling reversing a decision of an administrative board, the Court held that the Board of Nursing acted arbitrarily in deciding to close the School despite a pass rate of over 90 percent achieved by students who took the national licensing exam after graduating from a revised program implemented by the School in 2012. Most of these students are from Africa and speak English as a second language. Matt Boyer, Mary Akhimien, and Lauren DeLuca represented Leads before the Board and in the appeal to the Superior Court.
