New Filing Deadline for the District of Delaware Effective October 16, 2014

The United States District Court for the District of Delaware has issued an important new order affecting the filing and service deadline for all documents other than initial pleadings.

Effective October 16, 2014, “all electronic transmissions of documents [except for initial pleadings] . . . must be completed by 6:00 p.m. Eastern Time, in order to be considered timely filed and served that day.”  This includes “motions, briefs, appendices and discovery responses.”  Initial pleadings may still be filed before midnight Eastern Time to be considered filed that day.  Until October 16, 2014, the current deadline of midnight Eastern Time will remain in effect.
